The Criminal Procedure Act 2009 has been in operation for a few years now. While there continues to be interpretation and amendment of its provisions, the transition from the old legislation to the new has successfully been made, and a blog exclusively dedicated to the Act is no longer necessary.

2. Commencement


2. Commencement

(1) This Chapter comes into operation on the day after the day on which this Act receives the Royal Assent.

(2) Section 437 comes into operation on 1 July 2010.

(3) Subject to subsection (4), the remaining provisions of this Act come into operation on a day or days to be proclaimed.

(4) If a provision referred to in subsection (3) does not come into operation before 1 January 2011, it comes into operation on that day.


The Criminal Procedure Act 2009 received Royal Assent on 10 March 2009, and Chapter 1 came into force on that date. The commencement for most provisions was 1 January 2010. Some provisions, such as Division 2 of Part 2.3 (Notices to Appear), are 'pilot projects' and are not yet operating across the state.

This section was amended by s 51(a) of the Criminal Procedure Amendment (Consequential and Transitional Provisions) Act 2009, as part of re-numbering made necessary by that Act.
